Notice: Terms of Service & Subscription Updates

We are writing to inform you of important updates to our service policy and subscription plans, effective date, **September 01, 2025 **

Key Changes to Subscription Plans

Before Change: Subscription Plans: Free and Pro Free Plan: Allowed limited access to services with no specific licensing restrictions explicitly stated for generated content. Pro Plan: Provided access to paid services with the ability to use content commercially without detailed licensing terms.

After Change: Subscription Plans: Free, Starter, and Pro

Free Plan: Access to basic services remains available, but all content generated under this plan will now be subject to the Creative Commons Attribution-NonCommercial 4.0 International License (CC BY-NC 4.0). This restricts usage to non-commercial purposes only. Additionally, all intellectual property rights in outputs generated under the Free plan vest in ALTAVA upon creation, or you agree to assign such rights to us.

Paid Plan: Continues to offer premium features and allows commercial use of generated content, with members retaining ownership of their content (subject to the licensing terms outlined below).

Key Changes to Content Usage and Licensing

Before Change: Members granted ALTAVA a permanent, global, royalty-free, non-exclusive license to replicate, prepare derivative works, and publicly display assets created using the service. No specific distinction between commercial and non-commercial use for different subscription plans. ALTAVA retained rights to use member assets for business promotions or third-party platform advertisements without explicit licensing conditions for user content ownership.

After Change:

1. Public Content License: You grant ALTAVA a non-exclusive, irrevocable, perpetual, royalty-free, worldwide, and transferable license to use, reproduce, modify, copy, process, adapt, post, transmit, create derivative works, publicly display, and distribute all public content for purposes including service provision, maintenance, promotion, improvement, AI model training, new product development, or commercial purposes.

2. Free Plan Content Ownership: For users on the Free plan, all intellectual property rights in generated outputs vest in ALTAVA upon creation. If such rights do not automatically vest, you agree to assign them to ALTAVA and take necessary steps to perfect our ownership. Generated content is subject to the CC BY-NC 4.0 license, restricting usage to non-commercial purposes.

3. Private Content License (Starter and Pro Plans): You grant ALTAVA a non-exclusive, irrevocable, royalty-free, worldwide, non-sublicensable (except to related bodies corporate), and non-transferable license to use private content solely for fulfilling our obligations or exercising our rights under these terms. ALTAVA will not use, store, analyze, or process your inputs for AI model training, new product development, or commercial purposes without your express written consent.

4. Commercial Use: Starter and Pro Plans: Members can use generated content for commercial purposes, such as creating designs for end customers or selling/distributing designs through online marketplaces (e.g., Roblox Creator Marketplace), unless indicated for personal use only. Free Plan: Commercial use is prohibited under the CC BY-NC 4.0 license.

Next Steps

The updated Terms and Conditions will be available at altava.ai/terms. If you do not agree with these changes, you may terminate your service agreement and cease using the service by following the procedures outlined in the Terms and Conditions.
